These Terms and Conditions serve as the agreement (the "Agreement") between you ("you") and ATCO Inc., along with its affiliates and subsidiaries ("Company"), collectively providing the Rogers Rewards Program, Rogers Pay Debit, and associated services for which you have enrolled or are in the process of enrolling (collectively, the "Program"). You can contact the Company using the details on the back of your card or via the Contact Us section in the mobile application.
By using the Program, you confirm that you have read and agreed to these Terms and Conditions. If you do not accept these terms, you are not authorized to participate in the Program.
The Company reserves the right to modify, amend, add, remove, cancel, or alter any part of this Agreement at any time. This may include retroactive changes to Rewards (as defined below) already accumulated. Updates will be posted on the website listed on the back of your card or within the mobile application (the "Website"). Your continued use of the Program after such changes implies acceptance of the revised terms.
The Company may modify, suspend, or discontinue any part of the Program at its sole discretion, including benefits, discounts, promotions, offers, upgrades, exclusives, and Rewards. Access to certain features may be restricted or terminated without notice or liability. The Company also reserves the right to refuse service, revoke membership, and suspend or terminate accounts.
If you enroll in and use the debit card feature of the Program, you authorize the Company to withdraw funds from the checking account you provided during enrollment per the National Automated Clearing House (NACHA) rules for purchases made using your card(s), including via the mobile application. You must promptly report lost or stolen cards by contacting ZipLine Customer Service at 877-403-2222. You may update your banking details by calling ZipLine Customer Service or logging into Rogers Pay at www.rogers.market/rewards. ACH transactions may take up to three (3) business days to post to your account. You are responsible for ensuring sufficient funds are available at the time of the transaction. The Company may verify your identity and share transaction history with its affiliates, subsidiaries, or third parties for collection purposes.
Authorization for these transactions remains valid until you cancel your participation by contacting ZipLine Customer Service or visiting the Website. You remain responsible for any transactions made prior to cancellation. If your bank does not support electronic transactions, the Company may convert them into paper drafts. If a payment is rejected, you authorize the Company to resubmit the transaction and recover the amount, including any applicable return fees. Until outstanding balances are cleared, Program benefits may be suspended. To avoid issues, consider enabling Overdraft Protection on your linked account. The Company may also share information with third parties for identity verification, enrollment validation, and collection purposes, as outlined in its Privacy Policy.
You agree to indemnify and hold harmless the Company and its affiliates (the "Indemnified Parties") from any liabilities or costs arising from claims related to your violation of this Agreement, including legal fees. You must cooperate fully in resolving such matters and may not settle any claims without the Company's written approval.
The Program, including all content, functions, and materials provided via the Website or mobile application, is offered "as is." To the fullest extent permitted by law, the Company disclaims all warranties, including implied warranties of non-infringement, merchantability, or fitness for a specific purpose. The Company is not responsible for damages or technical failures related to your use of the Program, Website, or mobile application.
THE COMPANY IS NOT LIABLE FOR LOST OR STOLEN PROGRAM CARDS OR ANY DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES RELATED TO THE PROGRAM, REWARDS, AGREEMENT, MOBILE APPLICATION, OR WEBSITE. THIS INCLUDES LOST PROFITS, BUSINESS INTERRUPTIONS, EQUIPMENT DAMAGE, OR DATA LOSS. THE COMPANY’S MAXIMUM LIABILITY SHALL NOT EXCEED $100 FOR ANY DAMAGES ARISING FROM CONTRACT, TORT, OR OTHER CLAIMS, INCLUDING GROSS NEGLIGENCE.
Rewards cannot be exchanged for cash or equivalents and may not be assigned or transferred.
Rewards expire after 120 days of account inactivity, defined as a period with no purchases or redemptions.
The Company’s Privacy Policy is incorporated into this Agreement and can be accessed on the Website.
By using the Program, opening an account, or activating the Agreement through designated methods, you confirm that you are at least 18 years old and accept these Terms and Conditions. For individuals under 18, a legal guardian’s consent is required.
Any disputes related to this Agreement or the Program shall be resolved through confidential arbitration in Chatham County, Georgia, per the American Arbitration Association’s rules. You waive the right to a jury trial or class action. This does not apply to intellectual property disputes, for which the Company may seek legal relief in state or federal court.
This Agreement is governed by the laws of Florida, excluding conflict of law principles.
Disputes shall be resolved exclusively in Sarasota County, Florida.
You may not transfer this Agreement or any associated rights and obligations.
If any provision is deemed invalid or unenforceable, the remaining provisions will still apply.
A waiver of any provision is valid only if in writing and does not imply a waiver of other terms.
These Terms and the Privacy Policy constitute the entire Agreement between you and the Company regarding the Program.
Any claims related to your use of the Program must be initiated within one (1) year from the date they arise.
To enter Rogers Market’s Scratch & Win games, you must be a Rogers Rewards member and at least 18 years old. No purchase is required. Winning odds vary, and prizes are non-transferable and not redeemable for cash unless legally mandated. The offer may expire without notice. Disputes must be resolved through binding arbitration, and participants waive class action rights. The Company is not responsible for lost or stolen prizes and reserves the right to alter, suspend, or terminate the program at any time.
